WEEE / ElektroG - Basics
Regardless of the ElektroG amendment the following basics still apply:
The German Waste Electrical and Electronic Equipment Act (ElektroG or WEEE legislation) transforms EU WEEE directive 2002/96/EC into German law since March 2005. This applies to all electrical and electronic equipment placed on the market in Germany for the first time.
Exceptions exist, according to § 2 nr. 1 sentence 1 ElektroG only for military equipment, large scale stationary industrial tools, special medical products and electrical appliances, which are part of another device that does not fall within the scope of the ElektroG.
Affected manufacturers, importers and distributors have to register their company (or companies) as well as their brand(s) at “Foundation Electrical Equipment Register” (Elektro Altgeräte Register - EAR) before they are allowed to sell products in Germany.
The processing of this registration by the EAR takes currently about ten to twelve weeks. For this purpose, an insolvency-proof guarantee is required - to start with.

After access to the registration board, you must pay attention to compliance with the following obligations (be careful, almost all are vulnerable to penalties):
- Monthly reporting of your marketed and disposed goods to the Foundation EAR,
- annual update of the EAR registration, each with renewed proof of warranty,
- labeling of products with the symbol of the crossed-out wheeled bin, underlined with the black beam,
- Notification of the brand name or manufacturer of the product,
- Performing the WEEE ID in commercial documents and
- initiating of disposal and administration of related payments.
