What happens if you don’t register in?
Companies not registered within Foundation EAR may not trade their products in Germany Violating this rule means violating law, with the consequence of an expected fine of up to 50.000 Euros, escorted by a an interlocutory injunction, that stops trade.
When traders deal with products of other un-registered manufacturers, they are automatically covered by the rules of ElektroG (WEEE).
The list of registered manufacturers is public, via homepage of Foundation EAR. Thus anybody with internet access is able to clear registered from un-registered manufacturers. Hints on black sheep among the manufacturers and traders are receipted warmly by the ministry of environment.
The detected manufacturer will then firstly receive an order to lay out his view about his uncared responsibilities. After this written hearing in general there follows a non-compliance procedure.
Those manufacturers we’d warmly advise to contact us as soon as possible. The reaction time is quite limited and the matter quite complex. You shouldn’t lose time to (let us) get hands-on.
